US Judge Orders Release of Kilmar Abrego Garcia from Immigration Detention

Legal scene

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in immigration custody.

In her order, the court pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court proceedings involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Conditions of Release

The court, who was overseeing his petition to deportation in a Maryland district court, determined that he must now comply with the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This ruling represents a significant development in a complicated legal battle featuring claims of wrongful detention and disputed gang affiliations.
